1. About these Terms
These Terms and Conditions govern your access to and use of Sitezum.
Sitezum is a trading name of EFG GROUP LTD, a company registered in England and Wales under company number 16558737, whose registered office is at Ground Floor 5 North Court, Armstrong Road, Maidstone, England, ME15 6JZ.
In these Terms, “Sitezum”, “we”, “us” and “our” mean EFG GROUP LTD.
Sitezum provides an AI-powered website creation, editing and hosting platform.
By creating an account, purchasing a subscription or using Sitezum, you agree to these Terms.
If you use Sitezum on behalf of a business or organisation, you confirm that you have authority to agree to these Terms on its behalf.
2. Sitezum's services
Sitezum may allow users to:
- create websites using artificial intelligence;
- provide business information and content;
- upload logos, images, documents and other materials;
- request website changes using natural language;
- review, edit and publish website content;
- host websites;
- connect or use custom domains; and
- access other website creation and management features.
Features may change as Sitezum develops.
We may add, modify, replace or discontinue features where reasonably necessary to improve, secure or operate the service.
3. AI-generated content and editing
Sitezum uses artificial intelligence to generate content and understand website creation or editing requests.
AI systems can make mistakes.
You are responsible for reviewing website content and changes before publishing or relying on them.
You must check important business information including prices, offers, contact details, opening hours, product information, legal statements and other factual claims.
Sitezum does not guarantee that AI-generated content will be error-free, complete or appropriate for every business.
Nothing in these Terms excludes any obligation Sitezum has under applicable law to provide its service with reasonable care and skill.
4. Your account
You must provide accurate account information and keep your login credentials secure.
You are responsible for activity carried out through your account unless caused by a breach of Sitezum's own security obligations.
You must notify us promptly at support@sitezum.com if you believe your account has been accessed without permission.
You may not sell, transfer or provide access to your account in a way that breaches these Terms.
5. Your content
You retain ownership of content you provide to Sitezum.
You grant us a non-exclusive, worldwide licence to host, copy, process, adapt, display and otherwise use your content only as reasonably necessary to provide, operate, secure and improve the Sitezum service.
You confirm that you have the necessary rights and permissions to upload, use and publish your content.
You must not upload or publish content that:
- infringes intellectual property rights;
- unlawfully uses another person's personal information;
- is fraudulent or deliberately misleading;
- is defamatory;
- is illegal;
- contains malicious software or code;
- promotes unlawful activity; or
- otherwise breaches applicable law.
You remain responsible for the content published on your website.
6. Images, logos and intellectual property
You must have the right to use images, logos, trademarks and other materials you upload to Sitezum.
AI-generated material may be subject to legal limitations or third-party rights depending on the circumstances.
Sitezum does not guarantee that generated content will be capable of exclusive ownership, registration or trademark protection.
7. Subscriptions and payments
Certain Sitezum features may require a paid subscription.
Prices, billing frequency and included features will be shown before purchase.
Subscriptions may renew automatically at the applicable billing interval unless cancelled.
You authorise our payment provider to collect applicable subscription charges using your selected payment method.
If a payment fails, we may retry payment and may restrict access to paid features until payment is successfully received.
We may change subscription prices.
Where a price change affects an existing subscription, we will provide appropriate notice before the new price takes effect.
8. Trials and promotional offers
Sitezum may offer free trials, introductory pricing, promotional codes or other offers.
Eligibility and duration may vary.
Unless stated otherwise, a trial may convert to a paid subscription at the end of the trial period if payment details have been provided and the subscription is not cancelled before the trial ends.
Promotional offers may be withdrawn or changed for future users.
We may prevent misuse of trials or promotional offers.
9. Cancellation
You may cancel your Sitezum subscription using the cancellation options available in your account or by contacting support@sitezum.com.
Cancellation normally prevents future subscription renewals.
Unless otherwise required by law or stated at the time of purchase, access to paid features may continue until the end of the current paid billing period.
Nothing in these Terms limits any statutory cancellation or refund rights that apply to you.
10. Refunds
Except where required by law, subscription payments are generally non-refundable once the relevant billing period has started.
If you believe you have been charged incorrectly, contact support@sitezum.com.
We will consider billing errors and refund requests fairly and in accordance with applicable law.
11. Domains and third-party services
Sitezum may allow users to connect or obtain domain names or use services provided by third parties.
Third-party services may be subject to separate terms, policies and availability.
We are not responsible for third-party services outside our reasonable control.
Domain names may be subject to registry, registrar and renewal requirements.
You are responsible for maintaining any domain registration or third-party service that is not expressly included and managed by Sitezum as part of your subscription.
12. Acceptable use
You must not:
- use Sitezum for unlawful purposes;
- attempt to gain unauthorised access to Sitezum or another user's account;
- interfere with the security or operation of the service;
- introduce malware or malicious code;
- scrape, probe or attack Sitezum's infrastructure without permission;
- use Sitezum to impersonate another person or business unlawfully;
- publish fraudulent or deliberately deceptive websites;
- use the service to infringe third-party rights; or
- abuse AI, hosting or platform resources in a way that materially affects other users or Sitezum.
We may investigate suspected misuse.
13. Suspension and termination
We may suspend or terminate access where reasonably necessary because:
- you materially breach these Terms;
- payment remains overdue;
- your use creates a security risk;
- your website or content appears unlawful;
- your use materially harms Sitezum or other users; or
- we are legally required to do so.
Where reasonably possible, we will provide notice and an opportunity to resolve the issue.
Serious unlawful, fraudulent or security-related activity may result in immediate suspension.
14. Availability and changes
We aim to provide a reliable service but do not guarantee uninterrupted or error-free availability.
Sitezum may occasionally be unavailable because of maintenance, upgrades, security incidents, infrastructure issues or events outside our reasonable control.
We may update Sitezum and its AI systems from time to time.
15. Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
If you use Sitezum for business purposes, to the fullest extent permitted by law, Sitezum will not be liable for indirect or consequential losses, loss of profits, loss of business, loss of anticipated savings or loss of business opportunity.
Subject to liabilities that cannot lawfully be limited, our total aggregate liability arising from your use of Sitezum will not exceed the total fees you paid to Sitezum in the 12 months immediately preceding the event giving rise to the claim.
If you are a consumer, your statutory rights are not affected and any limitations in these Terms apply only to the extent permitted by law.
16. Your responsibility for your website
You are responsible for your business and the website you publish.
This includes ensuring that:
- business information is accurate;
- prices and offers are correct;
- claims about products or services are lawful;
- you hold appropriate permissions for content;
- your website contains any policies, notices or regulatory information required for your business; and
- your use of personal information collected through your website complies with applicable law.
Sitezum is a website technology provider and does not provide legal, financial, medical or regulatory advice.
17. Intellectual property in Sitezum
Sitezum and its software, branding, interfaces, systems, templates and platform technology are owned by us or our licensors.
These Terms do not transfer ownership of Sitezum's intellectual property to you.
You may use Sitezum only in accordance with these Terms.
You must not copy, reverse engineer, resell or exploit Sitezum's proprietary platform except where expressly permitted by law or agreed by us in writing.
18. Data protection
Our handling of personal information is described in our Privacy Policy.
If you collect personal information from visitors through a website created using Sitezum, you may have your own responsibilities under data protection law.
You are responsible for providing any privacy information required for your business and for using visitor information lawfully.
19. Ending your account
You may stop using Sitezum and cancel your subscription at any time.
You may request account deletion by contacting support@sitezum.com.
We may retain certain information where required for legal, security, fraud prevention, backup or legitimate record-keeping purposes.
20. Changes to these Terms
We may update these Terms to reflect changes to Sitezum, our services or applicable law.
Where a material change affects existing users, we may provide notice through Sitezum or by email.
Your continued use of Sitezum after updated Terms take effect will be subject to the updated Terms, subject to applicable law.
21. Governing law
These Terms are governed by the laws of England and Wales.
If you are a business, the courts of England and Wales will have exclusive jurisdiction over disputes arising from these Terms.
If you are a consumer, you may have rights to bring proceedings in the part of the United Kingdom where you live.
